Section 194Q ગયો નથી — તે Section 393 બન્યો, અને ₹50-lakh ની threshold ત્યાં જ છે
Section 194Q રદ નહીં, ફક્ત renumber થયો — ₹50-lakh ની threshold, 0.1% નો rate, અને ચૂકવા બદલ 30% disallowance, બધું જ Income-tax Act, 2025 હેઠળ હજુ ત્યાં જ છે, ફક્ત નવા section numbers હેઠળ જે મોટાભાગનું billing software હજુ પકડી શક્યું નથી.
- Section 194Q — purchase of goods પરનું TDS — દૂર નથી થયું. 1 April 2026 થી તે Income-tax Act, 2025 ના Section 393(1), Table 1, Serial No. 8(ii) પર છે.
- Test એ જ છે: જેનું ગયા વર્ષનું turnover ₹10 crore થી વધુ હતું એવો buyer, કોઈ એક resident seller પાસેથી ખરીદી આ વર્ષે ₹50 lakh વટાવે ત્યારે, ફક્ત ₹50 lakh થી વધુની રકમ પર 0.1% TDS કાપે.
- Deduction ચૂકી જાવ, અથવા કાપીને મોડું જમા કરો, તો એ purchase ના 30% ને business expense તરીકે disallow કરાય છે — એ rule પણ ખસ્યો, Section 40(a)(ia) થી Section 35(b) પર.
- Seller પાસે valid PAN ન હોય તો 0.1% ને બદલે 5%, નવા Section 397(2) હેઠળ — invoice આવ્યા પછી નહીં, purchase order જાય તે પહેલાં ચકાસવા જેવું.
Surat ના કોઈ પણ મોટા trading કે manufacturing પેઢી ને પૂછો કે "Section 194Q" એટલે શું, અને મોટાભાગની accounts team અટક્યા વગર જવાબ આપશે — એક supplier પાસેથી વર્ષે ₹50 lakh થી વધુ ખરીદો તો 0.1% કાપો. એ જવાબ July 2021 થી સાચો છે. તે ફક્ત 1 April 2026 થી ખોટા section number હેઠળ file થવા લાગ્યો, જ્યારે Income-tax Act, 2025 એ 1961 ના Act ને સંપૂર્ણપણે બદલી નાખ્યો અને લગભગ દરેક TDS provision ને નવું સરનામું આપ્યું.
જે પેઢી પહેલેથી આ TDS કાપતી હતી તેના માટે ગણતરીમાં કંઈ બદલાતું નથી. જે બદલાય છે તે એ છે કે rule ક્યાં બેસે છે, ખોટું થાય તો શું થાય છે, અને — જે કોઈ મોટા પ્રમાણમાં વેચે પણ છે અને ખરીદે પણ છે તેમના માટે — એક ખરી સરળતા જાણવા જેવી છે.
એ જ test, નવો section number
જૂના Act નો Section 194Q હવે Income-tax Act, 2025 નો Section 393(1), Table 1, Serial No. 8(ii) છે — એક જ consolidated table જે હવે લગભગ દરેક TDS provision વહન કરે છે જે પહેલાં પોતાના અલગ section હેઠળ હતું (194C, 194H, 194J, 194Q અને બીજા). આ ચોક્કસ row નું trigger બરાબર એ જ છે જે હંમેશા હતું: જો તમારી પેઢીનું ગયા વર્ષનું turnover ₹10 crore વટાવ્યું હોય, તો કોઈ એક resident seller પાસેથી ખરીદેલ goods પર, seller નું આ વર્ષનું total ₹50 lakh વટાવે ત્યારે, 0.1% tax કાપવો પડે — અને ફક્ત ₹50 lakh થી વધુની રકમ પર, આખી purchase પર નહીં.
સાદી ભાષામાં ઉદાહરણ: Ring Road પર ₹15 crore ના ગયા વર્ષના turnover વાળો fabric wholesaler, વર્ષ દરમિયાન એક Bhiwandi mill પાસેથી ₹80 lakh નું grey cloth ખરીદે છે. જ્યારે એ running total ₹50 lakh વટાવે, ત્યારે તેની ઉપરના ₹30 lakh પર 0.1% TDS લાગુ પડે — ₹3,000 કાપવા અને જમા કરવા, જે આ વર્ષે 194Q ને બદલે Section 393(1) તરીકે cite થાય. જો તમારા accounting software નું TDS drop-down હજુ "194Q" કહે છે, તો એ settings ની સમસ્યા છે, કાયદાની નહીં — deduction પોતે software update ની રાહ જોતું નથી.
Income-tax Act, 2025 એ business owner એ સાંભળેલ લગભગ દરેક TDS section નું નામ બદલ્યું. તેણે લગભગ કોઈ રકમ બદલી નહીં.
નવો number ક્યારથી લાગુ પડે છે તે તારીખ પણ દેખાય છે તેના કરતાં વધુ મહત્વની છે. Section 393 એવી purchases પર લાગુ પડે છે જ્યાં credit કે payment — જે પહેલાં થાય — 1 April 2026 ના કે પછી થાય. February 2026 માં થયેલ purchase હજુ જૂના Section 194Q હેઠળ જ governed છે, ભલે તમે એ TDS return ને પછીથી આ વર્ષે reconcile કરો. FY 2025-26 ની purchases અને Tax Year 2026-27 ની purchases ને તમારા books માં અલગ tag કરેલ રાખો — બંનેને એક section reference હેઠળ ભેળવવું એ આ વર્ષે પહેલેથી એક સામાન્ય reconciliation ભૂલ છે.
એક provision ખસ્યું નહીં — તે અદૃશ્ય થઈ ગયું
આ renumbering પહેલાં, Surat ના yarn કે fabric trader જે એક buyer ને વર્ષે ₹50 lakh થી વધુ goods વેચતા હતા, તેમણે એક જ transaction ની બંને બાજુ વિચારવું પડતું: buyer 194Q હેઠળ TDS કાપે છે, કે seller એ જૂના Section 206C(1H) હેઠળ TCS collect કરવું પડે? કાયદો કહેતો કે કોઈ એક sale પર બેમાંથી ફક્ત એક જ લાગુ પડે, પણ sale-by-sale, buyer-by-buyer એ નક્કી કરવું, જે પેઢીઓ મોટા પ્રમાણમાં ખરીદે અને વેચે બંને છે તેમના માટે ખરી compliance માથાકૂટ હતી.
એ overlap સારા કારણસર ગયું છે. Finance Act, 2025 એ Section 206C(1H) માં એક proviso ઉમેર્યો જેણે તેને 1 April 2025 થી inapplicable બનાવ્યો — Income-tax Act, 2025 પોતે અમલમાં આવ્યો તેના પૂરા એક વર્ષ પહેલાં — અને નવા Act માં તેના TDS કે TCS ના કોઈ table માં તેનું કોઈ replacement નથી. Surat નો seller હવે sale value ગમે તે હોય, goods ના sale પર TCS બિલકુલ collect નથી કરતો. domestic sale of goods પર બાકી રહેલો એકમાત્ર પ્રશ્ન એ છે કે buyer નું પોતાનું turnover અને purchase value તેમનું Section 393 deduction trigger કરે છે કે નહીં — જે buyer ની જવાબદારી છે, seller ની નહીં.
File માં valid PAN ન હોય, તો 0.1% નો rate પણ નહીં
જૂના Sections 206AA અને 206CC — જે PAN ન અપાયું હોય ત્યારે વધુ TDS કે TCS rate ફરજ પાડતા હતા — હવે Section 397(2) માં ભેગા થયા છે. Section 393 હેઠળ આવતી purchase માટે, એનો અર્થ એ કે valid PAN ન આપનાર seller પાસેથી, ₹50 lakh થી ઉપરની રકમ પર 0.1% ને બદલે 5% કપાય; Section 393(4) હેઠળનું declaration PAN વગર valid જ નથી.
Invoice આવ્યા પછી નહીં, purchase order જાય તે પહેલાં આના પર કામ કરવા જેવું છે. Surat ના ઘણા નાના job-workers, dyeing units અને unorganised suppliers હજુ દરેક buyer ને નિયમિતપણે PAN નથી આપતા — accounts team ને ચકાસવા કહો કે તમારા કયા regular high-value suppliers પાસે file માં PAN નથી, અને એ seller નો running total ₹50 lakh વટાવે તે પહેલાં મેળવી લો.
તમારા top suppliers એ તમારી accounts team ને valid PAN પહેલેથી આપ્યું છે કે નહીં, તેની ખાતરી નથી?
WhatsApp usખોટું કરો, તો કિંમત ફક્ત interest ની નથી
જૂનો Section 40(a)(ia) — દરેક ચૂકેલા કે મોડા TDS deduction ને પગલે આવતો disallowance rule — હવે Section 35(b) છે. Mechanics બદલાયા નથી: Section 393 હેઠળની purchase પર TDS કપાયું ન હોય, કે કપાયું હોય પણ return-filing ની due date સુધીમાં જમા ન થયું હોય, તો એ purchase ના 30% ને એ વર્ષનો profit ગણતી વખતે business expense તરીકે disallow કરાય છે. એ અલગ penalty નથી — તે તમે report કરો છો તે taxable income ને સીધું વધારે છે, વિલંબ માટેના interest ઉપરાંત.
ખરું ઉદાહરણ: Surat નું diamond-cutting unit એક domestic supplier પાસેથી વર્ષે ₹90 lakh ના rough stones ખરીદે છે અને threshold ઉપરના ₹40 lakh પર TDS કાપતું જ નથી. Assessment વખતે, એ ₹40 lakh ના 30% — ₹12 lakh — taxable profit માં ઉમેરાય છે, ભલે unit એ શરૂઆતમાં કાપવાનું હતું તે ₹4,000 નું TDS ક્યારેય વસૂલે કે ન વસૂલે. એક fallback છે: જો seller એ પોતાના return માં એ sale પહેલેથી report કરી હોય અને તેના પર tax ભર્યો હોય, તો chartered accountant નું આની પુષ્ટિ કરતું certificate disallowance અટકાવી શકે છે. એ ખરી relief provision છે, પણ તેનો અર્થ પછીથી તમારા seller પાસે cooperation માંગવું — શરૂઆતમાં જ સાચું કાપવાથી એની જરૂર જ નથી પડતી.
એક supplier સાથે આ વર્ષે ₹50 lakh વટાવી ગયા છો અને excess પર TDS કપાયું કે નહીં તેની ખાતરી નથી?

- PAN ન હોય તો 0.1% ને બદલે 5% (Section 397(2)); deduction ચૂકવાથી purchase ના 30% ને expense તરીકે disallow કરાય છે (Section 35(b)).
